Terms and Conditions

1. Information on how to participate in the offer and Cashbacks form part of these Terms and Conditions. Participation in the offer is deemed acceptance of these Terms and Conditions by each claimant.
2. This Promotion is available only to “Eligible Claimants” being individuals who (i) are Australian residents aged 18 years or older; (ii) are not employees of the Promoter or any of its related corporations or any of its agencies associated with this Promotion; and (iii) are not a spouse, defacto spouse, parent, or natural or adopted child or sibling of such an employee.
3. An Eligible Claimant who purchases a Qualifying Product from a participating authorised Australian retailer of JVC HD Everio Video Recorders, (second hand goods, or those sold at factory seconds outlets are not included) during the Promotion Period, commencing 9:00am (AEST) on 29/09/2008 and ending 11:59pm (AEST) on 31/12/2008 inclusive (“Promotion Period”) is entitled to claim, in accordance with these Terms and Conditions, a Cashback payment of two hundred dollars (AU$200.00).
4. The qualifying models are: GZ-HD5AA, GZ-HD6AA, GZ-HD10AA, GZ-HD30AA, GZ-HD40AA (“Qualifying Products”).
5. To be eligible to receive $200 Cashback, the claimant must log on to ,www.jvc-australia.com/cashback and complete and submit the online claim form. Upon successfully completing and submitting the online claim form the claimant will receive via their nominated email address a completed claim form along with a redemption how to checklist. The claimant must send one (1) fully completed claim form PLUS one (1) Proof Of Purchase in the form of a valid sales receipt PLUS one (1) original barcode cut from the box from a JVC Everio HD Video Camera with a business size stamped (50c stamp) self-addressed envelope to JVC Cashback Promotion, PO Box 657, North Sydney NSW 2060.
6. Claims must be received within 30 days of purchase. No responsibility accepted for late, lost or misdirected mail. Proof of posting is not proof of receipt. The Promoter and/or Supplier reserve the right to verify the validity of claims and to disqualify any claimant who tampers with the redemption process or who submits a claim that is not in accordance with these Terms and Conditions.
7. All claimants must ensure that their claims are received by the Promoter in accordance with the timeframes outlined above. The Promoter takes no responsibility for late, lost or misdirected claims or for any delays or failures in any telecommunications equipment. Claims that are received after the timeframes outlined above will not be eligible to participate in this promotion and will not receive a $200 Cashback.
8. The Cashback payment will be sent to the street address provided in the online claim form completed by the claimant. Cashback payments will be paid by cheque drawn in favour of the claimant as named in the submitted claim form. The cheque will be posted within 28 days of the receipt of a valid claim and must be deposited in the bank within 6 months of the issue date. Only one (1) claim per person may be made.
9. Claimants can only participate in their own name. The Promoter reserves the right to request the claimants to produce (within a reasonable time frame) documentation to the Promoter’s satisfaction in order to confirm each claimant’s identity, age, residential address and email address and eligibility to enter and claim a Cash back, before issuing a Cashback. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a claim has not been verified or validated to the Promoter’s satisfaction, that claimant’s claim will become invalid.
10. Cashbacks will only be awarded following any claimant validation and verification that the Promoter requires.
11. The Promoter reserves the right to verify the validity of claims and reserves the right to disqualify a claimant for tampering with the entry process or for submitting a claim which is not in accordance with these Terms and Conditions, or if the claimant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
12. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) whatsoever which is suffered or incurred by any claimant connected with this Promotion, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from or contributed to by negligence of a Relevant Party; (iii) any liability for personal injury or death.
13. The Promoter accepts no responsibility for any tax implications that may arise from the receipt of Cashbacks. Independent financial advice should be sought. The Promoter is not responsible for Cashback payments lost or damaged in transit.
14. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to claimant’s or any other person's mobile handset or computer related to, or resulting from, participation in this offer or the downloading of any materials related to this Promotion.
15. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
16. All received claims become the property of the Promoter. Claimants’ details are collected only to enable offer administration of this Promotion. If a claimant fails to correctly provide those details, their claim may not be processed and they may not receive their Cash back payment. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
